What are the Social Hosting
​
Laws in New Jersey?

Social hosts are individuals who are throwing a social gathering and serving alcohol legally. In order for this otherwise legal situation to be considered unlawful, the following will be taken into account:
  •An underage individual was provided alcohol
  •A guest or guests were served alcohol despite the social host being aware that the guest or guests were already visibly intoxicated
  •A social host provided alcohol to an individual knowing that they were going to operate a motor vehicle
  •Alcohol was served to a guest that lead to a dangerous situation
  •The social host allowed a situation which led to property damage or bodily harm which was reasonably foreseeable
Social host liability laws are in place to reduce alcohol related injuries and deaths by minors. Specifically, these laws impose a duty of care on party hosts not to furnish or serve alcohol to minors. 
Qué es el Alojamiento Social? y Cómo se vuelve ilegal?
Los anfitriones sociales son individuos que están organizando una reunión social y sirviendo alcohol legalmente. Para que esta situación, de otro modo legal, sea considerada ilegal, se tendrán en cuenta lo siguiente:
• Se le proporcionó alcohol a un menor de edad.
• Se le sirvió alcohol a un invitado o invitados a pesar de que el anfitrión social sabía que el invitado o invitados ya estaban visiblemente intoxicados.

New Jersey allows an injured person to seek damages from any social host who provided alcohol to an intoxicated person (at a party or similar event) when that guest goes on to cause an alcohol-related accident.
An injured person may seek damages from a social host if the social host provided alcohol to an intoxicated person who causes harm, and:
  •The person was visibly intoxicated in the presence of the host, or
  •The beverages were provided "under circumstances manifesting reckless disregard of the consequences" to another, and
  •The circumstances created an "unreasonable risk" of harm to life or property, and
  •The injury resulted from a motor vehicle accident caused by the intoxicated person who was served by the social host.
Cuáles son las leyes de hospedaje social en Nueva Jersey?
​Nueva Jersey permite que una persona lesionada reclame daños a cualquier anfitrión social que proporcionó alcohol a una persona intoxicada (en una fiesta o evento similar) cuando ese invitado causa un accidente relacionado con el alcohol. Una persona lesionada puede reclamar daños a un anfitrión social si el anfitrión social proporcionó alcohol a una persona intoxicada que causa daño, y:
•La persona estaba visiblemente intoxicada en presencia del anfitrión, o
